The person(s) whose signature(s) appear on this contract, known as "Client", agree that Drew Lacy, known as "Photographer", shall provide services to photograph their wedding and related events to the best of her abilities, in the manner described in this document. This is a binding contract, which incorporates the entire understanding of the parties, and any modifications must be in writing, signed by both parties, and physically attached to the original agreement. Client assumes responsibility for all collection costs and legal fees incurred by Photographer should enforcement of this contract become necessary. In the event that any part of this Agreement is found to be invalid or unenforceable, the remainder of this Agreement shall remain valid and enforceable. Any failure by one or both parties to enforce a provision of this Agreement shall not constitute a waiver of any other portion or provision of this agreement.
Retainer and Payment:
Client shall reserve the time and date of services by signing and returning this contract along with a non-refundable, non-transferable reservation retainer equal to $_________ which is 100% of the total photography fee. No date is reserved until the contract and retainer are received. If a payment exists, the balance due for the photography services must be paid in full no less than 10 days before the event date, and the terms and conditions of the arrangement shall be made between below. In the event Client fails to remit payment as specified, the Photographer shall have the right to immediately terminate this Agreement with no further obligation, retain any monies already paid, and not attend this event. Returned checks will be assessed a $50 non-sufficient funds fee, and all future purchases/payments must be paid by Cashier’s Check. There is no refund for cancellations under any circumstances.
Copyright:
All photographs taken by Drew Lacy are her property, will remain her property and are protected by United States Copyright Laws (USC Title 17). Client hereby waives any claims for ownership, income, editorial control and use of the images. Violators of this federal law will be subject to its civil and criminal penalties.
Reproduction:
Client has the right to print photos from any location HOWEVER, Photographer is not responsible for quality of prints. Client agrees not to scan, copy or reproduce images in any manner without giving full credit to photographer. A written release will be supplied with all digital files. The release grants Client the right to reproduce the images provided for their personal use only and DOES NOT allow the photos to be altered, sold or published. Any Social Media Filters added online, will be IMMEDIATELY asked to take down, and put the originals up. IF that Is not done, legal matters will pursue. Client further agrees NOT to-supply images to any third parties (including vendors associated with the wedding or album designers) WITHOUT DREW L. CLARK’S CONSENT!
Cancellation:
If for any reason Client cancels this contract before the wedding date, Photographer will keep the retainer, deposit, or full payment if made up front. Cancellation must be made in writing, signed by the contracted party, and sent via Certified Mail by the United States Post Office. If Client fails to supply written cancellation as specified before the wedding date or cancels within 30 days of the wedding date, Client shall be required to pay the full balance due.
Reschedule:
In the event that Client reschedules the wedding, there will be a $50 reschedule fee given the new date is available for the client. If the date is already taken, it is not the responsibility of the photographer, Drew Lacy Clark. For Mini Sessions, Retainer Fees/Deposits are non transferable or refundable.
Liability:
If Photographer is unable to perform any or all of the duties herein for any reason, including but not limited to, fire, transportation problems, acts of God, accident, illness, or technical problems, and if she cannot provide another competent professional, all money received by Photographer, minus expenses, will be returned to Client, and Photographer shall have no further liability with respect to this agreement. Photographer maintains the right at her discretion to choose another professional photographer in the event that an uncontrollable event takes place and interferes with the ability to shoot the event. This limitation of liability also applies to any loss/damage of photographs or failure to deliver photographs for any reason other than that of an act of god including fire, earthquake, flood, tornado, lightening or any other natural disaster. Liability for a partial loss of photographs shall be pro-rated based on the percentage of total. The sole remedy for any actions or claims shall be limited to a refund whose total amount cannot exceed the total monies paid by Client under this Agreement during the time preceding the date on which such liability arises. In the unlikely event of death, the photographer’s family cannot be held responsible for any liabilities including refunds.
Photo Discs, Products, and Jump Drives:
Upon receipt of Client’s Online Gallery, Client accepts all responsibility for archiving and protecting the photographs. NOT ON THEIR PHONE OR TABLET. They must back them up via Computer, Disc, or Jump Drive. Photographer does not permanently archive image files. Photographer is not responsible for the life span of any digital media provided or for any future changes in digital technology or media reader’s that-might result in an inability to read discs provided. It is Client's responsibility to make sure that digital files are copied to new media as required. If in the future a copy of the original CD of images is requested and available, there will be a charge of $100. Wedding Gallerie’s will be available for pickup or delivery in approximately 2-12 weeks from wedding date unless special circumstances arise. In the event that you can not back your own images up. Drew Can offer Plain Jump Drives MAILED to you for $45. CD’s are custom and $75, Custom Jump Drives that are acrylic, or wooden with your photo on the front/and or name, are $70. Prints start at $1. Canvases start at $40. Wedding Albums, Prints, and Print Boxes are Just a few of Heirloom Items Drew has to offer. Drew offers hundreds of products for you to choose from.
Pricing:
Services or merchandise not included in this initial contract will be sold at current price when an order is placed. All prices are subject to change at any time without notice. All print/album credits and sessions must be used within 60 days of web gallery posting or photographer may substitute a product of reasonable value to fulfill any outstanding credit balance.
Responsibilities:
Unless agreed upon in advance, DREW LACY CLARK shall be the exclusive photographer retained for the event. Drew may bring one assistant at her discretion. If Drew can’t make it due to an illness, or other unforeseen circumstance, She will have her Assistant Shoot, and she will edit. Videographers and other vendors as well as semiprofessional photographers must not obstruct or interfere with the official photography and are not allowed to take any still photos during formal sessions. Wedding guests may take photos IF, AND ONLY IF, they stay behind Drew at all times, and don’t interfere during the ceremony or at any other point. ALL ELECTRONICS NEED TO BE OUT OF THE PHOTOS DURING CEREMONY. THIS IS FOR YOUR BENEFIT. It is the responsibility of Client to prevent family and friends from interfering with Photographer's duties. Photographer is not responsible for compromised coverage due to causes beyond her control such as other people's camera or flash, the lateness of the bride, groom, family members and bridal party members or other principles, weather conditions, schedule complications, rendering of decorations, or restrictions of the venues or officiate. Photographer is not responsible for existing backgrounds or lighting conditions, which may negatively impact or restrict the photography coverage. Client understands that adequate lighting plays a key role in the quality of the pictures. Client agrees to confirm the schedule one-week prior to the event and to send the Photographer a copy of the invitation prior to the wedding. Notification of any changes in schedule or location must be made in a timely manner. Changes can be made by phone with a follow-up email for documentation. If email is sent, confirmation of receipt must be obtained.
Harassment:
Ensuring the appropriate behavior of all guests and other persons at the wedding and other events covered by Photographer shall be the responsibility of Client. In the event Photographer or her employee experiences any inappropriate, threatening, hostile or offensive behavior from any guest or other person at the wedding or other event (including, but not limited to, unwelcome sexual advances and verbal or physical conduct of a sexual nature) then the following process shall be followed: first offense: a verbal warning will be issued to a family member of the client; second offense: the offending person will be required to leave the-wedding or event; third offense: Photographer will end wedding coverage immediately and leave the event, Photographer shall be entitled to retain all monies paid hereunder and client agrees to relieve and hold Photographer harmless as a result of incomplete wedding or event photography coverage.
Coverage:
Photographer will provide coverage for the dates, locations and continuous hours specified in this Agreement. Additional travel or coverage hours may be added by agreement on the wedding day and must be paid in full before any photos or products are released to the Client. Every reasonable effort will be made to take requested pictures, but no specific pose or photograph can be promised. Any lists supplied will be used for organizational purposes only. Images determined by the photographer to be substandard or duplicated may be-edited out. The Photographer will use her professional judgment and sole discretion to select which photos to deliver. Such selection shall constitute all images that will be made available to Client. A copy of the un-edited images will be available for purchase for an additional $1,500. The number of pictures taken at each wedding varies depending on size of the wedding. Photographer will choose to edit a minimum of 75-100 images. ELOPEMENTS WILL BE 50-100 min.
Image Processing/Printing:
Unless agreed upon prior to any editing work, high-resolution gallery and/or proof sets may contain a mixture of color, black and white, and selective color images. An alternately colored version of a photo may be purchased at the current rate if the photo is still available . Limited color correction and/or retouching are included at Photographer's discretion. Client may request further changes for an additional charge. (Usually around $15-30 per photo.) Photographer is not-responsible for any prints that are not ordered directly from her. For best results, clients with the high-resolution-files should order their prints through a reputable lab. Photographer uses Millers Lab.
Model Release:
This contract serves as a model release giving the Photographer the irrevocable right to use the photographs in all forms and in all media and in all manners, without any restriction as to changes or alterations, for advertising, trade, promotion, exhibition, or any other lawful purposes. The Photographer can grant use of the images to third parties and all compensation for use and credit for the images remain the property of Drew Lacy Photography. ( Portraits by Drew - Drew L. Clark) Client waives any right to inspect or approve the photograph(s), finished version(s) incorporating the photograph(s), or the use to which it may be applied, including written copy that may be created and appear in connection therewith. This release is binding on the Client, their legal representatives, heirs, and assigns. This release covers minors and non minors.

Wedding Checklist | Formal Family Photos

I suggest for my wedding clients to think about what combination of relatives you would like in your formal photos and recommend you make a list of what formal family photos are essential for you.

The time spent planning the different group shots you require ensures that no one is missed, and it speeds up the process-which can otherwise drag on forever.

If you do have a smaller, uncomplicated family, then you might be able to skip this planning, but before you answer “yes” to that question - you better check with your soon to be Husband! 🙂
Some ideas to help in your planning:
1. Have a look at the following suggested group photos –Please add specific names if you can – that way we can ensure everyone is actually there by calling out names, instead of just asking for “extended family”.

2. Ask someone who knows both sides of the family to be in charge of helping me get everyone together. (Hopefully someone with a loud voice, If Not, I DO!!)
3. Before the wedding, let your relatives know that they will be required to stay after the ceremony for their formal photos.
Do not assume they know they will be required – grandparents may disappear early, parents may rush off to do last minute tasks for the reception, and it is easy to lose people to the bathroom!
4. Ask your helper to bring your list on the day (or email/text it to me the day before!)– that will help us ensure that we do not miss anyone, and the formal photos are as quick as possible.
5. Please also consider
- Stepparents we suggest a photo with your parents, and then with each parent (and their new partner if applicable). Please let us know if this applies to you.
- If you have elderly relatives we may need to take their photo first if they are unable to wait around.
- If mobility is an issue-for any of your guests who will be starring in the family photos please let us know.
- God parents
- Special friends or relatives not included in the above list.

- Will your wedding party be participating in toasts?
- Are there any divorced parents or family that I need to be aware of for picture purposes?
- What type of exit are you planning? Ex. Bubbles, Birdseed, Sparklers?
- Typically I arrive 1.5-2 hours prior to the wedding, allow 1 hour for the ceremony, and 2 hours for the reception. You can divide this 5-hour range up any way you feel fit.
- Please let me know if this is acceptable or do you prefer a different way?
- Are the bride and groom planning on doing a “first glance” setting before the wedding? If so, do you wish to have pictures taken during this time?
